Commentary on Measure K2016

Are you sure you want vote to support this extravagant measure? It has no accountability.

This campaign was designed by a member of the school bonds cartel. We figured out just the right words to get you to you to open up your checkbook.

We'd also like to introduce you to our partners -- bond lawyers, brokers, wealthy investors, architects, management firms, construction companies, and trade unions. We all stand to make a ton of money on these bonds. Our profits come right off the top, before a penny is actually spent on improving the facilities.

We're not just doing it for the money. We like to show off our work in Architectural Digest and other places where the rich and famous congregate.

Remember, we've taken a lot of risk. We gave money to get your governing board members elected, so they'd be sure to remember us when we came around for a hand-out later.

It's just business-as-usual, here in sunny Corruptifornia.

Please don't read the fine print. That's just put in by the lawyers to make what we're going to do to for you legal.

When you see highlighting in the documents below, it to see the commentary.

Impartial Analysis for Measure K2016

IMPARTIAL ANALYSIS BY COUNTY COUNSEL
MEASURE K2016
SANTA YNEZ VALLEY UNION HIGH SCHOOL DISTRICT

This measure was placed on the ballot by the Board of Education of the Santa Ynez Valley Union High School District, which is the governing board of the school district.

If approved by 55% of the voters voting on the proposition, this measure authorizes the Santa Ynez Valley Union High School District (District) to issue and sell bonds of up to $14,700,000 in aggregate principal amount to provide financing for the specific school facilities projects listed in the District's Project List. The Project List, as well as the full text of the measure, is printed in the ballot pamphlet. None of the proceeds from the sale of bonds may be used for teacher or administrator salaries or operating expenses.

The bonds and interest thereon would be payable from property taxes levied on taxable property in the District. These taxes would be in addition to the property taxes currently levied on taxpayers in the District. The amount of the increased taxes each year would depend upon the amount needed to pay the principal and interest on the bonds.

The bond measure includes the following accountability requirements:

A. A requirement that the proceeds from the bond sale be used only for the above purposes and not for any other purpose, including teacher and administrator salaries, and other school operating expenses.

B. A list of the specific school facilities projects to be funded and certification that the school district board has evaluated safety, class size reduction, and information technology needs in developing that list.

C. A requirement that the school district board cause to conduct an annual, independent performance audit to ensure that the funds have been spent only on the specific school facilities projects listed in the Project List.

D. A requirement that the school district board cause to conduct an annual, independent financial audit of the bond proceeds until all of those proceeds have been spent for the school facilities projects listed in the Project List.

E. If the measure is approved, the District Board of Education will also establish an independent citizens' oversight committee to monitor expenditures and ensure bond proceeds are used only to fund the specific projects listed in the Project List, as printed in the ballot pamphlet.

VOTE NO on Measure K2016 - $14.7 million SYVUHS bond. It is the best financial decision.

You are still a good person and care about schools even if you vote no on a school bond.

More debt and higher taxes are not the solution. California has the highest state taxes in the country.

Raises taxes on elderly and WWII vets without their consent.

No limit on taxation.

SYV Residents are already paying for $28,565,000 for elementary school district bonds – not counting interest.

Add this bond for a new total of $43,265,000 debt. Add interest averaging 3.5% at 20 years equals $73,550,500 total.

Then add in Allan Hancock's $180,000,000 bond you are still paying.

No guarantee that projects will be completed.

Examples of expenses:

$1.2 million: locker rooms

$1.3 million: state architect

$1.9 million: parking lot paving

The bond consultants were wrong on their projections for other school bonds – yet they don't have any risk for their mistakes. The taxpayers pay regardless.

The bond campaign consultants, lawyers, and bankers get paid from bond proceeds when passed.

The real winners here are those that issue the bonds and get the contracts.

Most local builders/contractors will not qualify to bid on these projects. The District will be required to hire expensive out of town contractors.

Now is not the time to impose a new tax burden on our community. VOTE NO on Measure K2016

Argument Against Measure K2016

ARGUMENT AGAINST MEASURE K2016
SANTA YNEZ VALLEY UNION HIGH SCHOOL DISTRICT

It is okay to vote no on a school bond.

Property taxes are already increasing. Let's keep property affordable for seniors and those on fixed income.

Renters are at risk for higher rents if bond passes.

School bonds should not be used for deferred maintenance.

How many other school bond assessments are you already paying? Some elementary schools are struggling to pay their bond debt.

We care about quality education and students having safe and decent place in which to learn, but cannot support this $14,700,000 bond.

Four years ago, local voters rejected the $19,840,000 school Bond Measure L.

The school's bond consultants estimate tax of $15.25 per $100,000 of assessed value. There is actually no limit on the assessment. Voters do not approve a fixed tax rate for general obligation bond indebtedness. Instead, the rate adjusts annually so that it raises the amount of money needed to pay the bond costs.

There is a $9 Billion California State Bond Measure on the same ballot to fund school facilities K-12. Let's go after that available money first.

Development Fees go directly to Santa Ynez Valley Union High School District. Hundreds of thousands of dollars are flowing into the school from many commercial and residential projects, including the 155 condos in Buellton, 169 homes in Skytt Mesa, and Golden Village and Inn in Santa Ynez to name a few.

SYVUHS is a basic aid school district, the school's revenues are derived from our property tax dollars that increase for most of us each year. This increase should go towards and set aside for deferred maintenance.

Vote NO to Measure K. Let's look at other funding sources first.

REBUTTAL TO ARGUMENT AGAINST MEASURE K2016
SANTA YNEZ VALLEY UNION HIGH SCHOOL DISTRICT

Don't be misled by the argument against Measure K2016. Measure K2016 is vitally needed to improve our Santa Ynez Valley Union High School campus.

Here are the facts:

Fact #1: Unless we pass Measure K2016, it will be impossible to "go after" money from the proposed California State Bond Measure. The State funding program requires a local match. The only way our District will have the funds necessary to receive State bond money in a meaningful amount is by passing Measure K2016. We are diligently pursuing both.

Fact #2: By law, developer fees may only be spent on projects necessary to accommodate new students generated by the project. Measure K2016's intentionally excludes projects that can legally be paid for by developer fees.

Fact #3: The district is seeking additional funding sources. Private donations are being sought to fund improvements beyond Measure K2016's reconstruction of critical infrastructure.

Fact #4: Measure K2016 limits the term of any bond issued to 15 years. By repaying the bonds quickly, taxpayers will save millions of dollars in borrowing costs.

Fact #5: Measure K2016 funds .

We've worked for two years to do the right thing for our community the right way. Measure K2016 provides the local dollars required to obtain state funding, does not fund projects that should be paid for by developers, and uses a prudent financing plan that will save taxpayers millions of dollars in interest costs.

Vote YES on Measure K2016!

SANTA YNEZ VALLEY UNION HIGH SCHOOL DISTRICT

BOND PROJECT LIST

RENOVATION, MODERNIZATION, REPAIR OF SANTA YNEZ VALLEY UNION HIGH SCHOOL

The facilities and improvements to be financed by the bonds issued for the District include the modernization, replacement, renovation, repair and other improvements to facilities at the site of Santa Ynez Valley Union High School.

Such projects shall include but shall not be limited to:

  • Repair/replace old and deteriorating plumbing including sewer and fresh water systems
  • Upgrade outdated heating, ventilation, and air-conditioning systems to improve learning environments and lower costs through energy efficiency improvements
  • Make handicap accessibility (ADA) upgrades and improvements to the school site, including restrooms and classrooms
  • Renovate and repair aging restrooms
  • Improve student safety by upgrading fire alarm, security, and emergency communications systems
  • Upgrade electrical system and lighting
  • Repair/replace deteriorating roofs
  • Replace windows and flooring
  • Improve safety and traffic flow of student drop-off and pick up locations, including improving parking lots
  • Repair dry rot and termite damage
  • Address unforeseen conditions revealed by renovation (e.g., asbestos removal, plumbing, gas line or electrical repairs, seismic or structural issues)

Each of the bond projects described in this include all costs incidental but directly related to the specific projects described above. Such costs include, but are not limited to, rental or construction of storage facilities and other space on an interim basis for materials and other equipment and furnishings displaced during construction, interim classrooms and facilities for students, administrators, and school functions but only to the extent such facilities are deemed necessary by the Board as a result of unforeseen conditions, addressing unforeseen conditions revealed by construction/modernization and other necessary improvements required to comply with existing building codes, including the Field Act, access requirements of the Americans with Disabilities Act, , bond issuance costs and project administration during the duration of such projects, .

Approval of the District's bond measure does not guarantee that all of the identified projects within this Bond Project List will be funded beyond what can be completed with local funds generated by the bond measure and does not guarantee that the projects will be completed in any particular order.

The order in which school facilities projects are listed above does not suggest an order of priority. Project priorities will be determined by the District Board. The District is unable to anticipate all unforeseen circumstances which may prevent some of the projects listed above from being undertaken or complete.

Measure K2016 Tax Rate Statement

Exhibit B

EXHIBIT B

TAX RATE STATEMENT

An election will be held in the Santa Ynez Valley Union High School District (the "District") on November 8, 2016, to authorize the sale of up to $14,700,000 in bonds of the District for the specific school facilities projects listed in the Bond Project List established by the District, as described in the proposition. If the bonds are authorized, the District expects to sell the bonds in one or more series. Principal and interest on the bonds will be payable from the proceeds of tax levies made upon the taxable property in the District. The following information is provided in compliance with Sections 9400-9404 of the Elections Code of the State of California.

(1) The best estimate of the tax rate that would be required to be levied to fund the bonds during the first fiscal year after the first sale of the bonds based on estimated assessed valuations available at the time of filing of this statement, is $.01525 per $100 ($15.25 per $100,000) of assessed valuation in fiscal year 2017-18.

(2) The best estimate of the tax rate that would be required to be levied to fund the bonds during the first fiscal year after the last sale of the bonds, based on estimated assessed valuations available at the time of filing of this statement, is $.01525 per $100 ($15.25 per $100,000) of assessed valuation in fiscal year 2019-20.

(3) The best estimate of the highest tax rate that would be required to be levied to fund the bonds, based on estimated assessed valuations available at the time of filing of this statement, is $.01525 per $100 ($15.25 per $100,000) of assessed valuation.

(4) The best estimate of the average tax rate which would be required to be levied to fund the bonds during the life of the bonds, based on estimated assessed valuations available at the time of filing of this statement, is $.01519 per $100 ($15.19 per $100,000) of assessed valuation.

(5) The best estimate of the total debt service, including the principal and interest, that would be required to be repaid if all the bonds are issued and sold is 18,753,000.

These estimates are based on projections derived from information obtained from official sources. The actual tax rates and the years in which they will apply may vary depending on the timing of bond sales, the amount of bonds sold at each sale and actual increases in assessed valuations. The timing of the bond sales and the amount of bonds sold at any given time will be determined by the needs of the District. Actual assessed valuations will depend upon the amount and value of taxable property within the District as determined in the assessment and the equalization process.

AND AUTHORIZING NECESSARY ACTIONS IN CONNECTION THEREWITH

WHEREAS, the Board of Education (the "Board") of the Santa Ynez Valley Union High School District (the "District"), within Santa Barbara County, California (the "County"), is authorized to order elections within the District and to designate the specifications thereof, pursuant to sections 5304 and 5322 of the California Education Code (the "Education Code");

WHEREAS, the Board, in a commitment to reduce the interest costs associated with the general obligation bonds and to not pass this debt obligation onto future generations, will limit the term of bond issuances to fifteen years or less;

-2-

NOW, THEREFORE, be it resolved, determined and ordered by the Board of Education of the Santa Ynez Valley Union High School District as follows:

Section 1. Specifications of Election Order. Pursuant to sections 5304, 5322, 15100 et seq., and section 15266 of the California Education Code, an election shall be held within the boundaries of the District on November 8, 2016, for the purpose of submitting to the registered voters of the District the following proposition:

BOND AUTHORIZATION

By approval of this proposition by at least 55% of the registered voters voting on the proposition, the District shall be authorized to issue and sell bonds of up to $14,700,000 in aggregate principal amount to provide financing for the specific school facilities projects listed in the Bond Project List attached hereto as Exhibit A, subject to all of the accountability safeguards specified below. Bonds will be issued in one or more series.

ACCOUNTABILITY SAFEGUARDS

The provisions in this section are specifically included in this proposition in order that the voters and taxpayers of the District may be assured that their money will be spent wisely to address specific facilities needs of the District, all in compliance with the requirements of Article XIII A, section 1(b)(3) of the State Constitution, and the Strict Accountability in Local School Construction Bonds Act of 2000 (codified at section 15264 et seq. of the California Education Code).

Evaluation of Needs. The Board of Education has conducted a facilities assessment in order to evaluate and address all of the facilities needs of the District, and to determine which projects to finance from a local bond at this time. The Board of Education hereby certifies that it has evaluated safety, class size reduction and information technology needs in developing the Bond Project List contained in Exhibit A.

Independent Citizens' Oversight Committee. The Board of Education shall establish an independent Citizens' Oversight Committee (section 15278 et seq. of the California Education Code), to ensure bond proceeds are expended only for the school facilities projects listed in Exhibit A. The committee shall be established within 60 days of the date when the results of the election appear in the minutes of the Board of Education.

Annual Performance Audits. The Board of Education shall cause to conduct an annual, independent performance audit to ensure that the bond proceeds have been expended only on the school facilities projects listed in Exhibit A.

Annual Financial Audits. The Board of Education shall cause to conduct an annual, independent financial audit of the bond proceeds until all of those proceeds have been spent for the school facilities projects listed in Exhibit A.

Special Bond Proceeds Account; Annual Report to Board. Upon approval of this proposition and the sale of any bonds approved, the Board of Education shall take actions necessary to establish an account in which proceeds of the sale of bonds will be deposited. As long as any proceeds of the bonds remain unexpended, the Superintendent shall cause a report to be filed with the Board no later than January 1 of each year, commencing January 1, 2017, stating (1) the amount of bond proceeds received and expended in that year, and (2) the status of any project funded or to be funded from bond proceeds. The report may relate to the calendar year, fiscal year, or other appropriate annual period as the Superintendent shall determine, and may be incorporated into the annual budget, audit, or other appropriate routine report to the Board.

BOND PROJECT LIST

The Bond Project List attached to this resolution as Exhibit A shall be considered a part of the ballot proposition, and shall be reproduced in any official document required to contain the full statement of the bond proposition.

The Bond Project List, which is an integral part of this proposition, lists the specific projects the District proposes to finance with proceeds of the Bonds. Such projects will be completed as needed. Each project is assumed to include its share of costs of the election and bond issuance, architectural, engineering, and similar planning costs, construction management, and a customary contingency for unforeseen design and construction costs. The final cost of each project will be determined as plans are finalized, construction bids are awarded, and projects are completed. Therefore the Board of Education cannot guarantee that the bonds will provide sufficient funds to allow completion of all listed projects.

FURTHER SPECIFICATIONS

No Administrator Salaries. Proceeds from the sale of bonds authorized by this proposition shall be used only for the construction, reconstruction, rehabilitation, or replacement of school facilities, including the furnishing and equipping of school facilities, or the acquisition or lease of real property for school facilities, and not for any other purpose, including teacher and administrator salaries and other school operating expenses.

Single Purpose. All of the purposes enumerated in this proposition shall be united and voted upon as one single proposition, pursuant to section 15100 of the California Education Code, and all the enumerated purposes shall constitute the specific single purpose of the bonds, and proceeds of the bonds shall be spent only for such purpose, pursuant to section 53410 of the California Government Code.

Other Terms of the Bonds. When sold, the bonds shall bear interest at an annual rate not exceeding the statutory maximum, and that interest will be made payable at the time or times permitted by law. The bonds may be issued and sold in several series, and no series of bond shall be made to mature later than fifteen years from the date of issuance.
